“Chun” Stay
or “Conditional Plea”: Effect From Supreme Court
Litigation
Because of
the pending New Jersey Supreme Court
DWI Case in which
I am involved, thousands of DWI cases will need to be reviewed
for possible reversal when the Supreme Court’s decision
is final. Depending on the basis for your conviction, you may
be able to reverse your conviction with the help of a knowledgeable
New Jersey DWI attorney. If you were or are convicted for DWI
in New Jersey anytime after 2005, I urge you to contact
New Jersey DWI attorney Bartholomew Baffuto, Esq. to explore your options
for possible reversal of your DWI conviction.
While the issue of the scientific reliability of the Alcotest
7110 has been pending decision, there was much confusion about
how each DWI case should proceed. Some courts went ahead with
guilty pleas or tried cases, and others did not. How your DWI
case was handled is the key to see if you may have a chance to
reverse your conviction.
“Chun-stay” status means that your case is on “stay” status
subject to the Supreme Court’s final decision in State
v. Chun, et al. Or, your DWI case might have been adjourned until
the “Chun” litigation is resolved. If you retained
an attorney, you should ask him or her about your status. You
may have a chance to try your case with the information that
has been disclosed during the “Chun” litigation,
which is a great advantage for a defendant. Again, I am involved
in this litigation and I formulated the strategy for the defense
team. I have gained a substantial amount of information and knowledge
about the Alcotest 7110. I am sure I could give you the best
DWI defense possible.
While “Chun stay” means you are in stay status, “conditional
plea”, means you are convicted subject to some conditions.
This “conditional plea” is not well defined. It is
something of a gray area. As soon as this “Chun” litigation
is resolved, this matter will probably be examined and evaluated.
Many defendants who were arrested after 2005 in New Jersey probably
have this form of conviction due to a procedural order from the
Supreme Court. Your records probably show that you have been
convicted already, but you are waiting for sentencing. Again,
in order to confirm your status, ask your attorney. If you did
not have an attorney, contact New Jersey DWI attorney Bartholomew
Baffuto, Esq. to explore options that may reverse your DWI conviction.
Whether or not you have “Chun-Stay” or “Conditional
Plea” status, if you are interested in reversing your conviction,
have all documents available and contact the New Jersey DWI attorney
Bartholomew Baffuto, Esq. to explore options that may reverse
your DWI conviction. You need to examine what your current status
is and investigate what you can do. With all findings and experts’ testimony
discovered by this “Chun” litigation, you may be
able to apply new lines of defense to reverse your conviction.
