B. I Created The Strategy
For The Defense Team
I created and developed the case
strategy for the defense team. Before I got involved in this
litigation, the tactics and technical complexity of the State’s
case were overwhelming the defense attorneys involved. Soon after
I created the defense case strategy, the defense team started
feeling that “we can win”. I filed a number of effective
motions developed with a statistician during case management
conferences. At the last management conference before the hearing
started in September 2006, I set the winning tone for the defense
team. The defense was pushing so much that the State
lost its momentum and reacted defensively for the first time.
The case management conference where I turned the tide is on
record, as is the entire series of hearings.
